DO I NEED TO PURCHASE TITLE INSURANCE? Yes, you need Title Insurance. Title Insurance is unlike other insurance, in that you pay for it once at the closing table and it lasts for as long as you own your home. Title Insurance insures the "Title" in your home. Without Title Insurance, if a title defect arises, we have seen first hand, owners who have spent thousands and years in Land Court unable to sell their home while they work to resolve the complex title issue.
I'M SELLING MY HOME AND HAVE A LISTING AGENT. DO I STILL AN ATTORNEY? Yes, sellers need attorneys too. Closing attorneys typically represent lenders, sellers will want an attorney to ensure that their own interests are represented in the sale of their home.
I'M BUYING A NEW HOME AND MY BANK HAS THEIR ATTORNEY INVOLVED. DO I NEED A SEPARATE ATTORNEY. Yes, as a buyer you may want your own attorney as well. Closing attorneys typically represent the lender's interest. Some lenders allow you to choose your closing attorney. Others will not, but will allow you to hire one to represent your legal interest.
